RVIA’s 2015 Capitol Hill Advocacy Day
On Wednesday, June 3, 2015, RVIA members visited 100 Congressional offices to raise awareness for the RV industry and a few key issues affecting the industry. Below is a breif description of each of the issues RVIA discussed on Capitol Hill. At the bottom of this page are PDF files of all the items RVIA members gave to Members of Congress and their staff during the meetings.
House and Senate RV Caucuses
RVIA members request that Representatives and Senators join the House and Senate RV caucuses. The House RV Caucus is co-chaired by Representatives Dennis Ross (R-FL-15), Jackie Walorski (R-IN-2), and Dina Titus (D-NV-1). The Senate RV Caucus was founded this year by Senators Joe Donnelly (D-IN) and Joni Ernst (R-IA). RVIA and its members are grateful to those members of Congress who have already joined the caucuses.
Housing and Urban Development (HUD) RV Exemption Clarification
Housing and Urban Development (HUD) rules surrounding the RV exemption to the Manufactured Housing Act need updating. Clarification is needed to clear up confusion regarding the line between recreation vehicles and manufactured housing in the HUD definition of manufactured home. In December, the HUD Manufactured Housing Consensus Committee (MHCC) recommended that a Rule be promulgated to resolve this issue by defining RVs by the RV standard to which they are built rather than by a complicated set of specifications. It is critical to the RV industry that this recommendation be enacted by HUD as quickly as possible. Recently, Administrator Pamela Danner indicated that Rule would be forthcoming in 2015. RVIA asks members of Congress to please contact HUD Administrator Danner and express thanks and support for expediting the Rulemaking that will clarify the distinctions between RVs and manufactured housing and ask that HUD share with your office what the Rule will propose.
Electronic Logging Device Exemption
Recreation vehicle trailers and motorhomes are transported in a one-time, one-way delivery where installation of an ELD is not practicable. In these instances, either the Record of Duty Status written form or an ELD should be sufficient to comply with commercial vehicle Hours of Service requirements. Section 31137 of title 49 USC requires a commercial motor vehicle operated by a driver subject to hours of service and record of duty status requirements to have an electronic logging device to improve compliance. The ELD requirement is not practicable for a driveaway towaway operator who is moving an RV trailer one-way with a pick-up truck or for an operator during a one-time, one-way motorhome delivery. Drivers delivering a motorhomes or operating pickup truck towing an RV trailer are currently required to prepare Hours of Service Records of Duty Status (RODs). Recognizing there may be limited options to address “policy-type” highway legislative issues, RVIA plans to return to congressional offices at a later time to explain why motor carriers, transporting RVs within the definition of "driveaway-towaway operation" (as defined in 49 CFR 390.5,) should have the option to require each driver to either: (1) use the Record of Duty Status form under the Hours of Service provisions or (2) require the driver to use an ELD installed in the vehicle.
Federal Lands Recreation Enhancement Act (FLREA)
FLREA governs the collection and retention of fees on federal parklands, forests, and recreation areas and allows the collection and retention of entrance and recreation fees by most of the major federal recreation providers. RVIA urges Congress to quickly approve H.R. 1991 or other legislation to reauthorize this vitally needed program to allow federal land agencies, in a time of diminishing federal budgets, to continue to serve the visiting public and provide the high-quality visitor amenities RV owners desire. In addition to the renewal, we ask Congress to include the Army Corps of Engineers in FLREA, giving the Corps the ability to retain the recreation fees collected at the park they were collected.
