EPA Reclassification Proposal
Under the Toxic Substances Control Act (TSCA) and related implementing regulations, the U.S. Environmental Protection Agency (EPA) is initiating a prioritization process for 20 chemical substances, including formaldehyde, as candidates for designation as High Priority Substances for risk evaluation.
Once the list is finalized as high priority chemicals, the agency will move into the scoping phase for conducting a risk evaluation. The publication of a final scoping phase, which will identify conditions of use that will be evaluated, triggers the fees rule, which can require manufacturers and downstream users to pay a fee to cover the cost of conducting the risk evaluation. Later, once the agency has published a final risk evaluation identifying the chemical as an unreasonable risk for a specified use, the agency will move into managing that risk. This could include any number of restrictions from requiring labeling to banning the use of the chemical for a specified use or all uses.
