USTR Considering Additional Exclusion Extensions On List 1 And 2 Products
The Office of the United States Trade Representative (USTR) will consider possible extensions of some List 1 and List 2 product exclusions. The List 1 exclusions being considered are the sixth set, which were granted in July 2019 and are scheduled to expire on July 9, 2020. The List 2 exclusions are the first set, which were granted in July 2019 and are set to expire on July 31, 2020. The U.S. Trade Representative will consider a possible extension for up to 12 months for both sets of exclusions.

List 1 included goods on China with a total annual trade value of approximately $34 billion and List 2 included goods totaling $16 billion. So far, USTR has granted extensions for 25 individual product exclusions, covering three separate rounds of exclusions. A total of 85 product exclusions were eligible for extension over these three rounds, and only 51 exclusions received comments. USTR has made no announcement regarding the continuation of these extensions after the additional 12-month period lapses.
The comment period for both exclusion lists opens on May 1, 2020 and closes on June 1, 2020 and interested parties can comment using USTR’s online portal. We encourage member companies to comment if they use any of the items on that list or reach out to the Association to comment on their behalf.
